The multi-millionaire heir to an ice cream fortune is tormenting his estranged wife by insisting she have sex with him before being allowed to visit their son, a new lawsuit charges.
Susanne Gold, 45, says David Smith, 52, hasn't allowed her to see their 11-year-old son since October, when she started to refuse her husband's demands, she says in a suit filed Tuesday in Nassau County Supreme Court.
“On condition that I have sexual relations with him, I do not ever see my son. I beg him, stop the harassment, let me see my son, and he refuses unless I'm back reconciling with him,” Gold said.
“This man is an evil man. He's tried to destroy me.”
Smith, of Roslyn, L.I., is a venture capitalist whose father was the CEO of CoolBrands, which made Esmiko Pie and Chipwich. He filed for divorce from Gold in January.
Smith's attorney, Lowell Sidney, said Gold's suit was an attempt to get the upper hand in the divorce, which includes a fight over custody.
“It's unfounded. It's defamatory,” Sidney said of Gold's allegations.
“David has done nothing illegal. The court found that he was the fit parent,” he continued.
Smith has spent $140,000 per week for three years on a team of six to 10 investigators to follow Gold's every move, she said in her suit.
She seeks $100 million in damages.
